Terms and Conditions for Travel Pal

Welcome to Travel Pal! These Terms and Conditions ("Terms") govern your use of our mobile application ("App"). By accessing or using Travel Pal, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the App. Please read these Terms carefully.

By creating an account, accessing, or using any part of Travel Pal, you accept these Terms, which form a binding legal agreement between you and Travel Pal. These Terms apply to all users, including users who contribute content, information, or other materials via the App. If you do not agree to these Terms, please discontinue using the App.

You must be at least 13 years of age to use Travel Pal. By using the App, you confirm that you meet this age requirement. If you are under the age of 18, you may use the App only with the supervision of a parent or guardian.

You are required to create an account to access certain features of the App. When registering, you agree to provide accurate and complete information. You are responsible for maintaining the security and confidentiality of your account and password. You are also responsible for all activities conducted through your account, whether or not authorized by you. Travel Pal reserves the right to refuse registration, terminate accounts, and reclaim usernames.

By using Travel Pal, you agree not to:

• Violate any applicable laws or regulations.
• Post, upload, or share content that is defamatory, obscene, pornographic, harassing, threatening, or otherwise inappropriate.
• Use the App for fraudulent or deceptive activities.
• Access, tamper with, or use non-public areas of the App or Travel Pal’s computer systems.
• Introduce viruses, malware, or other harmful code.
• Use the App to spam, distribute unsolicited or unauthorized advertising, or promote services not associated with Travel Pal.
• Attempt to gain unauthorized access to the App, other user accounts, or Travel Pal’s computer systems.
• Exploit the App for any commercial purposes not authorized by Travel Pal.

Failure to adhere to these guidelines may result in the immediate suspension or termination of your account.

You retain all rights to the content you upload, post, or otherwise share via Travel Pal ("User Content"). By submitting User Content, you grant Travel Pal a non-exclusive, worldwide, royalty-free, fully paid, transferable, sub-licensable, perpetual license to use, modify, distribute, display, and create derivative works of your content in connection with the operation and promotion of the App.

You are responsible for ensuring that your content does not infringe on the rights of any third parties and complies with applicable laws. Travel Pal reserves the right to remove or modify any content that violates these Terms or is otherwise objectionable.

All content on the App, including but not limited to the software, text, images, graphics, logos, videos, and other material, is the property of Travel Pal or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, reproduce, distribute, transmit, display, sell, or create derivative works based on any part of the App without express written permission from Travel Pal.

Your privacy is important to us. By using the App, you consent to the collection, storage, and use of your information as described in our Privacy Policy. We reserve the right to update our Privacy Policy and these Terms at any time. Any changes will be posted, and continued use of the App signifies acceptance of any new Terms or policies.

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of the course of dealing or usage of trade.

To the maximum extent permitted by law, Travel Pal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the App.
• Any bugs, viruses, or harmful code that may be transmitted to or through our App.
• Any third-party conduct or content.

In no event shall Travel Pal’s total liability to you for all claims exceed the amount you paid to Travel Pal, if any, for accessing the App in the past twelve months.

Travel Pal reserves the right to modify, suspend, or discontinue the App, or any part of it, at any time with or without notice. Travel Pal may also revise these Terms from time to time. The most current version will always be posted on our website or in the App. Continued use of the App after any changes to the Terms indicates acceptance of the new terms.

Travel Pal reserves the right to terminate or suspend your account or access to the App at any time, without notice or liability, if we believe that you have violated these Terms, engaged in prohibited activities, or are creating legal exposure for us.

You may terminate your account at any time by ceasing all use of the App. Upon termination, all licenses and rights granted to you in these Terms will immediately cease.

You agree to defend, indemnify, and hold harmless Travel Pal and its affiliates, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising from or related to:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights, including any intellectual property, privacy, or proprietary rights.
• Your User Content or any claim that your User Content caused damage to a third party.

These Terms and any disputes arising out of or related to them will be governed by the laws of the State of [Insert State], without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in [Insert State]. The arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association. You waive any right to participate in class actions.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the fullest extent permissible under applicable law, and the remaining provisions of the Terms shall remain in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity and enforceability of the remaining provisions.

These Terms, together with the Privacy Policy and any other legal notices published by Travel Pal, constitute the entire agreement between you and Travel Pal concerning the use of the App. Any prior agreements, whether written or oral, relating to the subject matter hereof are superseded by these Terms. No other communication or document, unless it is explicitly referred to in these Terms, shall be considered part of these Terms.

The failure of Travel Pal to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Travel Pal.

The App may contain links to third-party websites, services, or resources that are not owned or controlled by Travel Pal. These links are provided for your convenience, and Travel Pal does not endorse or assume any responsibility for any third-party content, services, or privacy practices. You acknowledge and agree that Travel Pal is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any such third-party services or resources.

Travel Pal may, at its sole discretion, release updates, patches, or new versions of the App to improve functionality, security, or user experience. You agree to download and install any updates promptly, and Travel Pal shall not be responsible for any issues arising from your failure to update the App.

Travel Pal takes the security of your personal data seriously, and we implement appropriate measures to protect your information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures. You acknowledge that you provide your information at your own risk. In the event of a data breach, Travel Pal will comply with all applicable laws regarding data breach notification requirements.

As a user of Travel Pal, you agree to follow these community guidelines:

• Be respectful of other users when posting content or interacting with the community.
• Do not engage in harassment, abuse, hate speech, or any form of discriminatory behavior.
• Refrain from posting content that promotes violence, illegal activity, or explicit materials.
• Report any content or behavior that violates these guidelines or the Terms. Failure to adhere to these community guidelines may result in account suspension, removal of content, or permanent banning from the platform.

Travel Pal provides users with the ability to post and share content such as travel photos, trip descriptions, and comments. You are solely responsible for the content you post and its accuracy. By submitting content, you represent and warrant that:

• You own the rights to the content or have obtained the necessary permissions or licenses.
• The content does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
• The content complies with all applicable laws and regulations.

Travel Pal reserves the right, but is not obligated, to review, remove, or refuse to display any content that, in our sole discretion, violates these Terms or is deemed harmful to the community.

The App is controlled and operated from within the United States. We make no representation that the App or its content is available or appropriate for use in locations outside of the United States. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

We welcome your feedback and suggestions regarding Travel Pal. However, any feedback or suggestions you provide shall be non-confidential and shall become the sole property of Travel Pal. By submitting feedback, you assign all rights to such feedback to Travel Pal, and we are free to use, modify, and implement the feedback without compensation or obligation to you.

Users have the ability to report inappropriate content or conduct to Travel Pal by using the reporting mechanisms provided within the App. If content or user behavior is reported and found to be in violation of these Terms, Travel Pal may take appropriate action, which may include removing the content or suspending or terminating the offending user’s account. Travel Pal reserves the right to act independently of user reports if inappropriate content or behavior is identified.
